Client Data & Coaching Terms of Agreement

This agreement is made between [Signed Party Below] and Honor Your Path Coaching, LLC (Cynthia Whittaker, ACC).

 

Both parties agree to the following:

COMMITMENT:
Coaching is a co-creative relationship between a coach and a client. The process of coaching yields success when
clients adjust habits, behaviors, and mindsets, subsequently transforming their perspective which brings about clarity.
Coaching is a structure that facilitates the process of personal and professional self-awareness. The client and coach
agree that the coaching relationship will be designed together and based on equality without judgment. Coaching is
for individuals who are emotionally, intellectually, and psychologically healthy and who want to make changes and
move forward in their lives. Coaching is NOT advice, therapy or counseling.


Progress happens at rates that are unique to each individual, so the coach and client commit to working with each other
for an initial three‐month period. This allows the coaching relationship necessary time to address road-blocks/barriers and establish healthy boundaries, which allows them to progress through goal setting, taking actions, and achieve SUCCESS!


CONFIDENTIALITY:
This coaching relationship, as well as all information (documented or verbal) that the client shares with the coach as
part of this relationship, is bound to confidentiality by the ICF Code of Ethics, but is NOT considered a legally confidential
relationship (like in Medicine or Law). The coach agrees not to disclose any information pertaining to the client
without the client’s written consent. The coach will not disclose the client’s name as a reference without the client’s
consent. Confidential information does not include information that: (a) is generally known to the public or in the
client’s industry; (b) is obtained by the coach from a third party, without breach of any obligation to the client; or (c)
that the coach is required by law to disclose.


LIMITED LIABILITY:
Except as expressly provided in this agreement, the coach makes no guarantees or warranties, expressed or implied. In
no event will the coach be liable to the client for consequential or special damages. Notwithstanding any damages
that the client may incur, the coach’s entire liability under this agreement and the client’s exclusive remedy, will be
limited to the amount paid by the client to the coach under this agreement for all services rendered up until the
termination date.

If a dispute arises out of this agreement that cannot be resolved by mutual consent, the client and coach agree to
attempt to mediate in good faith for up to 15 days after notice is given. If the dispute is not resolved, and in the event
of legal action, the prevailing party shall be entitled to recover attorney’s fees and court costs from the other party.


Investment:
1. To initiate services,  the first payment is due one week before initial service date unless otherwise specified.
2. All recurring monthly payments will be made via PayPal or Square on the first day of the month unless
otherwise discussed and agreed upon.

The Role of the Coach:
Having a coach means you have someone who supports you, motivates you, and holds you accountable for achieving
your vision for yourself. Whatever it is that you want in your life, I will navigate the path of turning barriers into
opportunities. Moreover, it's important to know that a coach must always keep an open mind, is entirely free
from judgment, and is NOT a therapist. They will focus mostly on looking toward your future, rather than dealing
primarily with your past. While there may be some commonalities between coaching and therapy, they are NOT one
in the same. It is my firm belief that my clients are competent individuals and have generally accepted their past
and want to put full focus on their future. Life coaches guide clients to their own solutions, focusing on the person
using insights and intuition, and tapping into a client’s strengths to facilitate desired outcomes.


Communication:
1. I understand that my 50-minute appointment includes a one-on-one telephone or zoom coaching session.
2. Payment is required prior to each coaching session.
3. Session cancellations and/or rescheduling must be made 24 hours before any scheduled coaching session by
email. If no notice or late notice is received, you forfeit your session and your investment. In the case of
emergencies, the situation will be handled on a case by case occurrence.
4. In the event of termination, no compensation will be granted on sessions used up to that point.
5. I understand that coaching sessions cannot take the place for professional advice by a medical doctor, lawyer, or
any other qualified Clinical Professional.
6. Coaching does not involve the diagnosis, therapy, or treatment of any kind. If you are seeing a physician for
mental health or any other health related issues, please consult with them before entering a coach-client
agreement.
7. As a client, you are responsible for showing up fully prepared and present for each coaching session; ready and
willing to invoke change with a positive attitude.

PROCEDURES:
Client is to Coach (number to be provided) at the appointed time for our sessions. Every attempt is made to begin on time;
however, if you call in and get my voice mail, please call back after two minutes.
